I would like to pick your brain for a moment....Hypothetically, if you could pass any one law the entire time you were in office, which law would it be and why?

Hi Sheri,
I agree that the rule of law is not always right and I do not believe it should be blindly followed by anyone. The great thing about the United States is that we can question our law givers about the laws they put in place. It is the job of the legislature to write the laws, and when necessary, to change them. If a law is unjust or violates the Constitution, it should be changed or removed.

I believe President Adams share the same sentiments on the above issue. We are a nation of laws, not of men, and no one is above the law, not even the government. One of the roles of the defense attorney is to ensure that the government is obeying the law, that is to say, upholding the law. If a person has been denied trial by jury, their home illegally searched, or cruel and unusual punishment inflicted (being drawn and quartered), then the rule of law has not been upheld.

QUOTE: Dan does not see the role of the defense counsel as to “get someone off the hook necessarily” but to see that the rule of law is upheld.

The above statement worries me. The "rule of law" is not always right. There is more to it than simply enforcement of the law. The law must be judged and unjust law must be changed, not enforced.
